General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all contracts between the

and their customers through the platform www.eyecon.ai.

The offer is aimed exclusively at entrepreneurs within the meaning of § 14 BGB. Conflicting or deviating terms and conditions of the customer shall not apply unless EyeCon expressly agrees to their validity in writing.

3. Conclusion of Contract

The presentation of the products on the portal does not constitute a legally binding offer. The contract is concluded by the customer's order and subsequent confirmation by EyeCon.

In the case of digital services, the contract is considered fulfilled as soon as the scan has been carried out and credited to the user account.

4. Prices and Terms of Payment

All prices are net plus VAT.

Payment processing is done via Stripe. Accepted payment methods are credit card, PayPal, prepayment and, in exceptional cases, invoice with payment term.

EyeCon reserves the right to provide services only after receipt of payment.

5. Test scans

Users who register up to and including 30.06.2026 will receive five free test scans. Test scans are non-transferable, non-payable, and do not entitle you to future free services.

6. Delivery of hardware

Starter kits will be shipped to the shipping address provided by the customer. Delivery times are non-binding, unless expressly assured.

The risk of accidental loss is transferred to the customer upon handover to the shipping service provider.

7. Retention of title

Delivered hardware remains the property of EyeCon GmbH until full payment has been made.

8. Customer's Obligations to Cooperate

The customer is obliged to provide suitable and legally permissible video recordings. He ensures that he has all the necessary rights to the uploaded content.

9. Liability

EyeCon is liable without limitation in the event of intent and gross negligence.

In the event of simple negligence, EyeCon shall only be liable in the event of a breach of material contractual obligations and limited to the typically foreseeable damage.

Liability for production losses, lost profits or indirect damages is excluded to the extent permitted by law.

10. Warranty

For digital services, no guarantee is given for a specific analysis quality or complete error detection.

The statutory warranty rights apply to hardware, unless manufacturer's rights take precedence.

11. Term and Termination

Contracts for scan packages end when the scans are used up or the agreed term expires.

The right to extraordinary termination remains unaffected.

12. Confidentiality

Both parties undertake to keep confidential information confidential.

13. Data protection

The processing of personal data is carried out in accordance with the Privacy Policy.

14. Place of jurisdiction and law

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction is - as far as legally permissible - the registered office of EyeCon GmbH.

15. Severability clause

Should individual provisions of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
